- Counts as winning if a court order gives lasting relief and changes the legal relationship
- Also counts if the case ends with an enforceable written agreement or consent decree
- Also counts if the defendant or government agency drops the challenged practice, ending the case
- Applies to cases pending when the law passes and cases filed afterward
