Makes clauses that push retirement and health plan members into private arbitration, or make them give up class actions or a lawyer, unenforceable, and keeps them out of plan documents.

  • Covers mandatory arbitration clauses written into retirement and health plan documents
  • Also covers class action waivers, representation waivers and discretionary clauses
  • Arbitration clauses forced on members after a dispute arises would also be unenforceable
  • Such clauses could not be put in plan documents or other agreements with members
