Replaces surprise-billing arbitration with a set payment formula
Starting in 2028, out-of-network payment fights would be settled by a fixed formula rather than a dispute process, for care covered by private health plans.
- As of Jan. 1, 2028, payment disputes would no longer go to an independent reviewer
- Pay rates would be based on 2019 regional median rates, raised by inflation each year
- Federal rules for setting the new rates would be due within 180 days of passage
- Yearly audits of these payments would be required and made public starting in 2028
