Excludes employer child care from overtime pay calculation

Lets employers provide or pay for child or dependent care without that value counting toward the hourly rate used to figure an employee's overtime pay.

  • Overtime hours must be paid at 1.5 times an employee's regular rate of pay
  • That regular rate is an average hourly rate that must include certain pay, like commissions
  • The value of employer-funded child or dependent care would be left out of that rate
