Changes who counts as a tipped worker for minimum wage
Redefines a tipped employee under wage law so that job duties no longer matter when deciding who can be paid a lower base wage with tips making up the rest.
- Tipped workers may currently be paid under the $7.25 minimum if tips cover the difference
- The bill counts any worker receiving tips plus cash wages at or above the minimum wage
- An employee's duties would no longer be considered when deciding if they are tipped
- The work period used to make this decision would be set by the employer
