Sets care rules for children born alive after abortion
Requires health workers to care for and hospitalize a child born alive after an abortion, report failures to law enforcement, and face penalties; the mother cannot be prosecuted.
- A health care worker present must give the same care as for any other child born alive at the same age
- The child must be taken to a hospital right away
- A worker or employee who knows care was not given must report it to law enforcement
- Penalties include a fine, up to five years in prison, or both; the mother cannot be prosecuted and may sue
